Terms of Service

These Terms govern your use of Tezzap, a service provided by Kameswar Digital Services("we", "us"). By creating an account or using the service, you agree to these Terms.

1. The service

Tezzap is an AI-powered WhatsApp automation platform for Indian small and medium businesses. It enables you to deploy an AI receptionist on your WhatsApp number to respond to enquiries, book appointments, and capture leads.

2. Eligibility

You must be at least 18 years old and operating a legally registered business or profession in India. You represent that the information you provide is accurate and that you have the authority to bind your business to these Terms.

3. Account responsibilities

  • Keep your credentials secure.
  • You are responsible for all activity under your account.
  • Notify us immediately of any unauthorised use.

4. Acceptable use

You agree not to use Tezzap to:

  • Send unsolicited bulk messages (spam).
  • Send content that is illegal, fraudulent, defamatory, obscene, or infringes intellectual property.
  • Violate Meta's WhatsApp Business Policy or Commerce Policy.
  • Impersonate another person or business.
  • Attempt to reverse-engineer, scrape, or circumvent our platform.

We may suspend or terminate accounts that violate these rules without refund.

5. Fees and billing

  • Plans are billed monthly in advance via Razorpay.
  • All prices are in Indian Rupees and exclusive of GST.
  • Failed payments may result in service suspension after 7 days.
  • No refunds for unused portions of a billing cycle; you keep access until the cycle ends.

6. Intellectual property

Tezzap (including software, design, and content) is owned by Kameswar Digital Services. You retain ownership of content you upload (your knowledge base, customer data). By using the service you grant us a limited licence to process your content solely to deliver the service.

7. AI-generated content

Tezzap uses third-party AI models (Google Gemini, Anthropic Claude) to generate responses. While we implement guardrails, AI outputs may occasionally be inaccurate. You remain responsible for the final content sent to your customers on your behalf.

8. Warranties and disclaimers

The service is provided "as is". We do not warrant uninterrupted or error-free operation. We disclaim all implied warranties to the extent permitted by Indian law.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or loss-of-profit damages.

10. Termination

You may cancel anytime from your dashboard. We may terminate for material breach with reasonable notice. On termination, your data is retained for 30 days for recovery, then deleted.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Kakinada, Andhra Pradesh.

12. Changes

We may update these Terms from time to time. Material changes will be notified by email 30 days before taking effect.
